Fire Pits and Recreational Burning

A permit from the Winston-Salem Fire Department is NOT required for recreational fires, portable fireplaces or cooking fires as long as you comply with following:

  1. Guidelines
  2. Charcoal and Gas Cooking Devices
  3. Hazards and Violations
  • The fire must be fueled by clean, seasoned firewood, natural gas or other clean burning fuel.  
  • The fire is not used for disposal of waste.  
  • The fire’s total fuel area can be no more than three feet in diameter and no higher than two feet.  
  • Recreational fires shall not be conducted within 25 feet of a structure or a combustible material. Conditions which could cause a fire to spread within 25 feet of a structure shall be eliminated prior to ignition. 
  • Portable outdoor fireplaces shall be used in accordance with the manufacturer’s instructions and shall not be operated within 15 feet of a structure or combustible material. 
    • Exception: Portable outdoor fireplaces used at one and two family dwelling
  • Fires shall be constantly attended until completely extinguished. A minimum of one portable fire extinguisher with a minimum 4-A rating or other approved on-site fire extinguishing equipment such as dirt, sand, or water shall be immediately available.
