City Statement on Workers’ Compensation Process

The city of Winston-Salem issued the following statement regarding its workers’ compensation process, and the protocols that it must follow, in response to a recent story in the Winston-Salem Journal regarding Sgt. Michael McDonald:

“In 2019, the city solicited proposals for the provision of legal services for the city's workers’ compensation matters. It is not unusual for employers to hire outside counsel for such matters.

“A local law firm won the bid. The city worked to transition most of its workers’ compensation matters to this firm in 2020. This firm was not retained to represent the city in a specific workers' compensation matter.    

“There is a statutory process for handling workers’ compensation cases. This process does not afford the city the ability to comment upon such cases or to challenge, in a public forum, the accuracy of statements regarding a specific case. Due to various laws, the city is obligated to protect the confidentiality of certain information, even before a workers’ compensation claim has been officially filed. 

“Unfortunately, the city has sustained multiple employee losses due to COVID-19. Multiple city departments are grieving the loss of employees due to COVID-19. As the city deals with these losses, it is important to remember that all city employees and their families deserve a workers' compensation process that affords a thorough and consistent review and application of the law."
