No, Internal Revenue Service rules state that the maximum is $5,000 per household, an employee and spouse would not be allowed to both enroll in the maximum of $5,000. If you are single, the maximum you can contribute to the dependent FSA is $5,000. If you’re married and you and your spouse elect to participate in a dependent care FSA, then your combined dependent care FSA account cannot exceed $5,000.
